2. Host of the Site
The Site is hosted by GoDaddy Europe, which has its headquarters at The Shipping Building, Old Vinyl Factory, 252-254 Blyth Road, Hayes, UB3 1HA, United Kingdom (telephone: 09 75 18 70 39 / email: HQ@godaddy.com). Lucky cart’s applications (api.www.luckycart.com, go.www.luckycart.com, app.www.luckycart.com, mon-jeu.fr) are hosted by Google Cloud Platform in Saint-Ghislain, Belgium.
General Terms of Use of the Site
1. Purpose
The purpose of these general terms of use (“GTU”) is to govern access to and use of the Site and its content by the user (“You”). By using the Site, You agree to the GTU.
We reserve the right to amend any part of the Site and/or the provisions of the GTU. If substantial changes are made to the latter, we will inform You of them through a special notice displayed on the Site. You must read the GTU carefully in order to familiarise yourself fully with the changes made.
2. Intellectual property
The overall structure of our Site, including software, and all content disseminated (images, articles, photographs, logos, trademarks, videos, interviews, sound, text, etc.) are the property of Lucky cart or are used by Lucky cart after obtaining authorisation from right-holders (such as the logos of some of our clients which we use with their prior agreement) and are protected by current intellectual property legislation in France, including copyright, associated rights, trademark rights, image privacy rights and current international legislation.
All reproduction rights are reserved, including for photos, text and icons.
As such, without explicit authorisation from us, or the company concerned, for the referencing page on which our clients’ logos appear, it is strictly forbidden to reproduce, copy, represent, broadcast or publish, temporarily or permanently, all or part of the contents of the Site, on any medium or by any means whatsoever, for purposes other than personal viewing, and to alter, translate, arrange or adapt them in whole or in part and create derived works. It is also forbidden to decompile, disassemble or reverse engineer the Site.
Under no circumstances may the fact that the Site can be used in accordance with the GTU be interpreted as giving You any intellectual property right in relation to the Site.
3. Responsibility
The purpose of the Site, which can be accessed online free of charge, is to present Lucky cart’s activity and the services it offers. We strive to offer an online offering with accurate and complete content. However, it is not possible for us to prevent all errors and so we cannot accept any responsibility for the currency or completeness of the information provided.
We reserve the right to alter, add to, delete or temporarily or permanently stop publishing parts of the Site or the entire offering without warning.
We shall make every effort to ensure that the Site is accessible seven days a week, 24 hours a day, subject to interruptions necessary for technical maintenance, upkeep and update processes which we deem appropriate. Access to the Site may also be limited or interrupted due to malfunctions or interruptions in computer and telecommunications systems.
You must take all appropriate steps to protect your data and/or software from any viruses circulating on the Internet. Therefore, we cannot be held liable for any direct or indirect damage which is or may be caused to you due to (i) direct or indirect consequences which may result from errors in entry of details or any other incomplete or inaccurate information provided by you through this Site, (ii) any unavailability, slowdowns and/or difficulties in accessing the Site caused by your faulty or slow Internet connection, and (ii) a security breach or any other breach, including presence of malware, and/or any incompatibility of hardware, software and operating systems that you use to access the Site.
The creation of so-called “deep” hypertext links to the Site is subject to the prior agreement of our publication manager.
4. Applicable law and court with jurisdiction in the event of a dispute
These GTU are subject to French law.
Any disputes concerning them shall be referred to the courts with jurisdiction in Paris.
We will not participate in any dispute resolution process before a consumer conciliation body.
